Model Art Commissions Terms of Service

DISCLAMER

By commissioning the services of Colza56, you agree to the following Terms of Service between Colza56 (hereinafter referred to as the “Illustrator”) and yourself (hereinafter referred to as the “Client”) with respect to the creation of illustrations (hereinafter referred to as the “Artwork”).

General Terms

• The client, agrees they are of legal age and assumes full responsibility for any money exchanged for this service.
• The Illustrator reserves the right to refuse or discontinue a commission at their discretion. Upon the latter the client will be fully refunded (Detailed in a later segment)
• Client will receive a full resolution .png file and the cut PSD source file of the completed Artwork. No other working files will be distributed, and no physical goods will be shipped.

Payment & Fees

• Full payment is required upfront before the commencement of work, once the quote is agreed upon. 
• The client agrees to pay the invoice in full via PayPal in US Dollars (USD) within forty-eight (48) hours. If payment is not received, the slot will be relinquished to another client.

Revisions

• During the sketch phase, the Client may ask for multiple free revisions. However if the Client and Illustrator cannot come to an agreement after 3 sketch passes, Illustrator will refund and cancel the commission.
• Once the final Artwork has been turned in, any revisions requested that are not due to any fault on the part of the Illustrator (such as but not limited to forgotten details, incorrect depictions or colour adjustments), an additional fee shall be charged.

Commercial Use & Merchandising

• Model designs are authorized for commercial use.
• The client holds the right to create and sell physical or digital merchandise using the provided artwork.

Usage policy

• Illustrator reserves the right to stream the creation of the Artwork publicly, and post Works in progresses (W.I.P.s) to Illustrator’s social media . If Client requires the creation of Artwork to be private, Client agrees to pay a 20% of total Non Disclosure Agreement (NDA) fee.
• Client agrees to not claim the creation of the Artwork as their own.
• Client agrees that no version of the Artwork shall be used as a Non Fungible Token (NFT) or in AI datasets in perpetuity.
• All rights not expressly granted hereunder are reserved to the illustrator. Including but not limited to all rights in sketches, mock ups, or other preliminary materials. Illustrator will not seek to resell or re-use the Artwork unless the Client breaks the terms listed above.

Prohibited Uses & Content Restrictions

• The use of any part of the deliverables for the creation of pornographic content, hate speech, or discriminatory activities is strictly prohibited.
• Applications from individuals or entities intending to use the work for these purposes will not be accepted.
• Failure to comply with these restrictions will result in the immediate termination of the usage license.

Cancellation & Refunds

• No refunds will be issued once the project has commenced.
• PayPal transaction fees are non-refundable under any circumstances.
• A full refund will be provided only if the Illustrator is unable to complete the project due to personal or technical reasons.
